New UK IPO address for service rules
UK IPO has introduced new address for service rules [put link in here] which require a UK address for service for all contentious trade mark and design matters before it.
Under the new rules, should an application be made to invalidate or revoke for non-use a UK trade mark or design registration, including cloned rights created on the UK’s exit from the European Union, where there is currently no UK address for service, the UK IPO will send a notice to the trade mark owner’s address requesting that a UK address for service be appointed within a period of one month. If no address for service is appointed, the UK IPO will treat the invalidation action or revocation as unopposed and cancel the registration. If a UK address for service is appointed, then the UK IPO will serve the cancellation action on the UK address.
If an opposition is filed against the UK designation of your International Registration, the UK IPO will issue a provisional refusal via WIPO in the usual way but will now require a UK address for service be appointed to defend against the opposition..
